Punishment to Rehab Mental Disorder 

Fear is in instinct of human nature. Fear is based on prompt justice. Prompt justice is based on effective and efficient justice system supported by state. Without placing effective justice system, human could not be controlled or trained to value others. Unfortunately, ineffective justice system here in Pakistan has been providing grounds to criminals. It is unfortunate, indeed. Over the past 3 decades of governance, governance system has been turning from poor to worst. Judiciary is one of the key pillars of state presents meager performance. Multiple reasons are behind lengthy and ineffective litigation process. Access to justice is one of the key problems victims have been facing. Political and administrative interference have been causing attributing in manipulation of residua system. With the passage of time confidence of people over judicial system is descending. Reported data of litigation is not supporting initiatives taken to streamline the litigation, state has been claiming.

As result of existing judicial system, overall governance structures are sacrificing. Nepotism, illicit practices, practices, embezzlement and favoritism are taken normally. But the most painful side of overlook of judicial system is increasing number of rapes of minor children across country. Minor children, both girls and boys have been targeting by mentally sick people. The pedophiles in rural and urban areas, most are relatives of victims, have been wandering in presence’ of law enforcement agencies. The apprehended culprits are escaped conviction because of flaws of First Investigation Report (FIR) and poor prosecution. The apex court even took multiple suo-motu notices but pedophilia crimes are on the rise. This shows that such cases are not priority of police department indeed which is disgusting and alarming situation. The reported data, seventy seven of rape of minor girls had reported in 2018 only in Lahore from January – August 2018. It means, averagely nine cases in a month. Similarly, eleven cases were reported in Saddar, five in civil lines and two cases in Iqbal town police stations. The situation is also equally abysmal in the cases where the minor boys were sexually abused. Recent research conducted by Sahil organization reveals that more than 60% cases of sexual assault are not reported due to multiple reasons. According to the police’ data, total 79 boys suffered sexual assault in various parts of the city during the same period. In most of the cases, the boys were abducted when they were playing in the street or going to local shops in residential areas. Most of these cases (25) were again reported in the Cantonment Division, followed by Saddar (20) and Model Town (17). Other divisions where these cases were reported include Iqbal Town (eight), City (six) and Civil Lines (three). The data showed that eight out of the total 79 cases were quashed by police owing to “lack of evidence” or other reasons. Shockingly, none of the suspects in both categories (boys, girls) of these cases have so far been convicted. The official figures reveal that in all the 141 cases the accused secured bail from courts. On the other hand, police sources say that since most of the victims belong to poor families, many cases of child sex abuse go unreported in the city.
The heinous crime rises only due to lack of effective prosecution and lack of rehabilitation. There is immediate need to set precedents and to engage criminals in rehabilitation process. Moreover, the fear is the only tool that could control crimes especially sexual abuse of minors and harassment at work places even.

  4. A very well written article. All the state institutions from top to down have been miserably failed to fulfill their duties. Its not just the judiciary system but also our so called democratic and liberal politicians and the parliament. They are still following the British Colonial Laws and they literally damn care. Today in 2019 a person will get a reward of rupees 5 if he/she kills a dangerous snake. Its sounds so pathetic but we do still have these kinds of other laws related to judiciary, trials and human rights. Its the equal duty of the government and judiciary to work together to amend the laws according to the needs of today's era. Police is also one of the worst institution we also have from the independence but the promises of bringing reforms could never be fulfilled.
